A MAN accused of the manslaughter of a 64-year Kelso man on Monday afternoon has been formally refused bail but is expected to make a release application on Wednesday.

Daniel John Duke, 35, of Bonnor Street in Kelso, made a brief appearance before magistrate Cate Follent in Bathurst Local Court on Tuesday.
Solicitor Peter Ringbauer indicated to the court that his client would possibly be making a release application, but not until the following day. He made a request to the court for the matter be stood over until February 27.
Duke, who greeted his partner who was sitting in the courtroom as he was led into the dock, was charged with manslaughter in the early hours of Tuesday morning following the death of 64-year-old Jeffrey Robert O'Connor.
As he walked into the courtroom he said to the woman sitting metres from him, "look, no shoes," before sitting down in the dock.
After Mr Ringbauer made an application to have the matter stood over until Wednesday, Ms Follent formally refused bail, which was not applied for.
She then made an order for his next appearance to be via audio-visual link.
As he was led away, Duke blew kisses to the woman sitting in the gallery, who wept quietly as he was led away.
Duke was arrested by police at the scene of an alleged altercation in Bonnor Street on Monday afternoon, where police allege he caused the death of Jeffrey Robert O'Connor in circumstances amounting to manslaughter.
Police and paramedics rushed to the scene just after 5pm, with police establishing a crime scene around a block of Bonnor Street units adjacent to the Kelso Community Hub.
As the incident unfolded a large crowd of people gathered across the road. Minutes later the Toll helicopter, called to the scene by emergency crews, landed on the rear oval of the Kelso Community Hub.
It remained there on standby as paramedics worked on the victim.
They performed CPR on Mr O'Connor, who was unconscious and laying outside the door of an upstairs unit in the complex.
He was later transported to Bathurst Base Hospital via road ambulance in a critical condition, but died a short time later.
The matter is back before Bathurst Local Court on Wednesday, with Duke to appear via AVL.
