Cr Bourke applied for an apprehended violence order against Michael Griffiths, of Havannah Street, back in August and an interim order was put in place by visiting magistrate Roger Prowse.
Mr Griffiths opposed the order and it went to hearing before magistrate Cate Follent on Wednesday.
Ms Follent will hand down her decision next Tuesday, December 3.

At Wednesday's hearing, Mr Griffiths made submissions that the application contained "blatantly false and misleading allegations".
He said the application alleged there were incidents of violence and assaults against other people on his police record, adding that Cr Bourke's solicitor, Shane Cunningham, had been given evidence "that this was blatantly wrong".
Mr Griffiths said Cr Bourke's application lacked evidence, in particular a video of an alleged altercation in a Bathurst newsagency.
Mr Cunningham told the court he didn't understand Mr Griffiths' prejudice, as the brief of evidence served by Mr Griffiths actually contained the video.
In submissions, Mr Griffiths said that on the day of the alleged altercation he went to enter the newsagency when a male person yelled out "get out of the way you [expletive] idiot".
He said he put his hands up "to protect himself" because, he told the court, he had only limited use of both his arms and his legs.
However, Mr Cunningham submitted that Mr Griffiths changed direction to make contact with Cr Bourke.
Mr Cunningham submitted that the video, which was shown to the court, indicated the incapacity spoken of by Mr Griffiths did not seem to inhibit his ability to pivot off his left knee and change direction from left to right towards Cr Bourke.
He said the video shows Cr Bourke stepping back but being stopped a hand rail behind him. He said Cr Bourke then left the store saying words to the effect of, "I hope that's on CCTV".
