Bathurst Regional Council has, in a narrow vote, decided to keep all the conditions it imposed when approving the development application for the site on the corner of Stewart and Howick streets in June.
The applicant, McDuck Properties, had lodged a modification requesting that a condition, which required ingress to site via Howick Street and egress only via Stewart Street, be deleted.
McDuck Properties' Hector Abbott later told the Western Advocate that the condition could put the project "in jeopardy" if councillors didn't change their mind.
The request was put to council's meeting on Wednesday night, with a recommendation from planning staff not to delete the condition.
Councillor Alex Christian attempted to have the condition deleted, delivering an explosive final appeal in which he told councillors to think about the jobs that could be lost if Taco Bell abandoned the project.
"Of course it's about jobs, it might create about 50 of them for our young people and if that's not a good story, I might as well walk out of this chamber right now because that's an embarrassment," he said.
"... This is an absolute disgrace and, you know what, if they walk away that will not be on me, those lost jobs will not be on me, and this council's reputation will not be on me."
However, he was unable to garner enough support in the chamber.
Mayor Bobby Bourke, deputy mayor Ian North and councillor Monica Morse voted in support of his motion, but they were overpowered by the five votes from councillors Warren Aubin, John Fry, Graeme Hanger, Jess Jennings and Jacqui Rudge.
MORE TO COME.
