There is something extremely important being lost in this issue.
The land was bequest to the community, meaning the entire Bathurst population and visitors, not for one select group to lock up this land for their exclusive use.
I believe that any use other than what the bequest intended for use as a public park by the whole community is in breach of the terms of how and why it was left to the community and was entrusted to be used for.

Changing the use may well breach the terms of the deed of ownership or trust deed.
To proceed without respect for why it was left as a total community space is totally disrespectful of the McPhillamys and their wishes and intent.
I believe this needs to be fully legally investigated to ensure that council are not breaching any terms of the bequest, including reference back to the will or any connected documents that authorised that transfer of ownership and set out the terms by which council were given the land and the intended purpose of use.
It is disgraceful on council's part to treat that legacy in such a way as to not respect the McPhillamy wishes.
People would be hesitant to trust leaving anything to the community via council in future.
When is somebody going to give that the respect and consideration it deserves?
