The latest Section 10 application, which came to the attention of Bathurst Regional Council about six weeks ago, was a big talking point at last week's monthly meeting.

Councillors were voting on two notices of motion proposing to find an alternate site for the go-kart track.

Both motions were lost, with the same five-four split people have come to expect.

Councillor Warren Aubin slammed calls to relocate the track to the second circuit precinct, not only for financial reasons but because council could encounter the same issues due to a new Section 10 application. It covers a bigger area than other applications and includes the second circuit site.

"Cr Jennings, Cr Fry, Cr Morse, how do you all sit back and say it's an easy fix to move the go-kart track to the second circuit precinct knowing full well that it's under a Section 10 application? And you knew that," Cr Aubin said.

"It's just trying to pull the wool over the eyes of the community that everyone's happy if you move it down there - there's a Section 10 that's been placed on that area.

"And not only is it on the second circuit area ... but you've got an area from the Vale Road to the Blayney Road, from Brilliant Street to the Hen and Chicken Lane and everything in between there is under this Section 10.

"You've got a university, a TAFE college, a land information centre, Mount Panorama Racing Circuit, motorcross track, harness racing, bike park - everything is in there ... and I also mention 150 private dwellings that are in that area.

"People should be very, very worried that this Section 10 has been placed on that large area and why."

It's not only councillors who are concerned, with council's general manager David Sherley telling the Western Advocate the "ramifications" are unknown.

"Council is concerned about the placement of the Section 9 and 10 applications, as they cover a much greater area than the go-kart track proposal," he said.

"The ramifications will not be known until the wording of any such order, if approved by the [Environment] Minster, is received by council.

"It is of concern that the Section 9 and 10 applications include areas utilised for events at Mount Panorama, such as the camping areas at the top of Mount Panorama."

Mr Sherley said there's been complaints made about activities on Mount Panorama, including the pruning of trees, and council has written to Minister Sussan Ley about the Bathurst 6 Hour to ensure it won't be impacted.

Councillors Fry and Jennings have said these issues will go away if council relocates the track, referring to a letter council has received from the Traditional Owners group's lawyers.

"I understand the concerns that are held by this council as an organisation, regardless of which side of the debate you stand on, but I would point out it is, I think, a positive step in the first instance now that we have that letter that actually indicates a willingness, in writing, to change path, to, in writing, go about this another way," Cr Jennings said.

Council is currently waiting on a decision from Ms Ley that will determine the future of the go-kart track at the top of Mount Panorama.
