Bathurst Regional Council's current Local Environmental Plan 2014 and Development Control Plan (DCP) 2014, while addressing overshadowing of neighbouring dwellings, do not cover controls relating to overshadowing of a neighbour's solar hot water system, or solar panels resulting in loss of energy generation.
Perhaps this omission is something that council continues to investigate, to strengthen its DCP to provide equitable access to sunlight and energy generation for residents in the community.
Setting a limit of percentage loss of energy generation could be a way to assess a development application, especially since the increase in take up of solar panels is occurring in existing and new neighbourhoods.
Other NSW local government areas such as North Sydney and Newcastle have already included such controls in their DCPs.
