Bathurst Regional Council has stood by its decision on a development application relating to a caretakers dwelling at Bathurst Goldfields.

In May, council approved a DA the construction of a single-storey caretakers dwelling and shed with an attached carport at the Goldfields on Mount Panorama.
The site currently contains numerous buildings used for multiple purposes, including tourist and visitor accommodation, a function centre and an information and education facility operating as Bathurst Goldfields.

The caretakers dwelling and shed that was proposed is ancillary to the dominant uses of the land for tourist and visitor accommodation, a function centre and information and education facility.
There was an objector to the proposal, and they were not made aware that the matter was to be considered by council at its May meeting due to an administrative error by council.
Written notifications of the council meeting were prepared for the applicant and objectors however, the email address of the objectors was spelled incorrectly and they did not receive the letter.
After receiving the letter advising them of the outcome of the May 19 meeting, the objectors wrote a complaint to council stating that they were not provided fair notification that the application was to be considered on that night.
Accordingly the matter had to be reconsidered by council at the July meeting.
The recommendation from council's planning staff was to reaffirm the resolution from the May meeting.
"Whilst it is noted that council did in good faith attempt to notify the adjoining landowner(s) of the council meeting and that council has met its statutory obligations in relation to person(s) making a submission in relation to a development application, the application has again been referred to council to offset any remaining concerns of the objectors," the report from council's planning department said.
"The additional submissions do not raise issues that have not been dealt with in the previous assessment of the application. It is recommended that council reaffirm its resolution made at the ordinary meeting of council held on May 19, 2021."
Councillors accepted this advice and voted accordingly.
As such, consent has been granted and the applicant will be required to adhere to the conditions attached to that consent.
One of the complaints of the objectors was the impact on their views, but council staff said that there would only "be a minor to moderate impact on the loss of views".
Staff also noted that the proposal was consistent with the objectives of the zone.
