Bathurst Regional Council is set to make a decision on a development application for a One Strength gym during Wednesday night's ordinary meeting.
It is the last ordinary meeting scheduled for the year and staff have recommended that council grant consent to the plans.
However, there would be a long list of conditions attached to that consent if the recommendation is adopted as written.
The proposal requires the demolition of two existing buildings, being a shed and skillion roof structure, and the change of use of an existing shed building to a recreation facility (indoor) - gym, as well as the partial demolition, additions and alterations to an existing shed building and the construction of an 18-space car park.
Signage, an almost two-metre high fence and gate, and roof-mounted solar system are also proposed to be installed.
If approved, the gym would operate from 4am to 9pm on weekdays and 6am to 4pm on weekends.
The development would front Manilla Street.
An extensive report on the proposal is included in the business papers for the night.
It touches on the heritage significance of the site and what impact the proposed development could have, concluding that "the proposed development will not result in any significant adverse impacts on the heritage significance of the item or surrounding Heritage Conservation Area".
One of the main issues to arise from the development is a shortfall of parking.
Council has determined that the site is required to provide 39 on-site parking spaces, but only 32 are proposed to be provided.
Staff have recommended that developer contributions of $134,721.30 be imposed.
The recommendation also proposes a condition prohibiting group fitness classes, which would help to control the demand for parking.
Council staff explicitly stated that the contributions should not be waived.
"A waiver of contributions would increase the cost of providing public carparking facilities for the current and future populations of the Bathurst region and could set an unwanted precedent for other CBD-based commercial/recreational developments to follow," the report states.
Concerns regarding noise were also raised.
The proposed development does not comply with the sleep disturbance levels identified by the NSW EPA Noise Policy for Industry, and "may impact on the amenity of the surrounding residential area".
Council staff have proposed conditions of consent to ensure the predicted noise sources are limited to an appropriate level.
"Should Council be satisfied that the proposed development can exist in harmony within the surrounding residential area and that the proposed carparking shortfall can be appropriately absorbed within the CBD, the development could be approved, but with numerous conditions of consent as recommended," the report states.
