Earlier
MITCHELL Barnes and his co-accused Aaron Sheehan have both been refused bail in Orange Local Court on charges of shooting with intent to murder following an alleged drive-by shooting in Heatherbrae Parade in the early hours of Saturday morning.
Police allege Barnes and Sheehan, both aged 20, were in a vehicle driving past a house at 1.55am on Saturday.
The house was occupied at the time of the incident.
A lead indicated the car’s occupants were in a maroon-coloured Ford Falcon sedan, and on Sunday at about 9am, police arrested Barnes on Bathurst Road.
He appeared in Orange Local Court on Monday morning where he was led into the dock handcuffed, wearing jeans and a white singlet top.
He did not speak during his brief appearance.
No application was made by Barnes’ solicitor for bail, and bail was refused.
Following his arrest at 5pm on Monday, Sheehan was held in police custody and appeared in Orange Local Court early yesterday afternoon.
Sheehan’s solicitor, Andrew Rolfe, put forward a submission to the court to grant bail to his client, who was allegedly driving the vehicle, saying his level of involvement was not clear at this stage.
However police prosecutor Sergeant Beau Riley said police had a strong case both Barnes and Sheehan had pre-planned the drive-by shooting.
Sheehan did not speak, but stared a young female at the back of the court, who did not make eye contact.
She wiped away tears as Magistrate Terry Lucas refused bail, saying the case would probably proceed to the District Court as Sheehan, like his co-accused, was charged with strictly indictable offences.
Barnes is charged with shoot with intent to murder, discharge firearm with disregard for victims and stalk/intimidate.
Sheehan is charged with shoot with intent to murder (aid and/or abet), and fire firearm likely to injure person (aid and/or abet).
Both men have been remanded in custody to reappear in Orange Local Court in June.
