Ben Robert Ashford, 35, of Esrom Street, West Bathurst, appeared before magistrate Michael Allen in Bathurst Local Court charged with mid-range PCA and being a never licensed person driving on the road.
Police facts tendered to the court told how on August 4 last year Ashford was driving south along Currawong Street when he was pulled over by police.
Police had followed his Ford Falcon for a short period, before activating their warning lights and pulling Ashford over for the purpose of a random breath test.
Police stopped the car, approached it and introduced themselves.
They asked him for his driver’s licence, but Ashford couldn’t produce one, admitting freely to police he did not have one.
Police asked him to get out of the car, and they observed him to be unsteady on his feet and his breath smelt of intoxicating liquor.
A breath test produced a positive result and Ashford was arrested and taken back to Bathurst Police Station.
There, he recorded a breath analysis reading of 0.101.
In relation to his drinking, Ashford told police he had five stubbies of Toohey’s New and a self-mixed Jim Beam and Coke between 4.30pm and 10.20pm that day at a friend’s house.
On the drive with middle range PCA, Ashford was disqualified for 12 months and ordered to undertake 120 hours of community service, including 20 hours sober driving program.
He was also ordered to report to Probation and Parole within five days.
The second charge, never licensed person drive on road, was dealt with by way of a section 10A conviction.
