Damian Leslie John Albon, 49, of Bant Street, South Bathurst, appeared before magistrate Michael Allen in Bathurst Local Court on February 12 to answer a charge of mid-range PCA.
Police facts handed to the court told how Albon was pulled over by police in Littlebourne Street, Kelso on October 23 last year just before 2pm.
He had been driving his Mitsubishi Lancer on the Great Western Highway when police saw the vehicle drift within its lane as it travelled west before turning left on to Littlebourne Street.
Police facts said officers stopped the driver for a random breath test.
The court heard that when highway patrol officers approached the vehicle and spoke with the accused, they said his eyes were bloodshot and glazed and they could immediately smell alcohol on his breath.
The roadside breath test returned a positive reading and Albon was arrested and taken to Bathurst Police Station, where he recorded 0.132.
In relation to his drinking, the accused told police he had consumed a number of Carlton Dry stubbies in his lunch break at work.
Mr Allen convicted Albon, disqualifying him for eight months to date from October 23, 2017, with Section 206B of the Road Transport Act to apply.
Albon was also placed on a Section 9 bond for 12 months and ordered to accept Community Corrections supervision, with the emphasis on monitoring of compliance with attendance of alcohol programs as directed.
