The tree, which is located near Larkin Street and bears the name of Doug Kinlyside, was found damaged on Thursday morning.
The damage was reported to Bathurst Regional Council, however it is unknown what the cause was.
“The damaged tree was noticed by a council staff member first thing this morning,” a spokesperson said.
“A replacement tree is being sought and will be planted during council's winter planting program.
“Council is unable to determine if the damage was caused by environmental factors or vandalism.”
While the cause is unknown, there was a storm on Wednesday afternoon that may have contributed to the incident.
This is not the first time that council has had to replace one of the Living Legends trees.
In March 2017, six Living Legends trees had to be replaced after an act of vandalism, while another tree was damaged in December that same year.
Two more trees were found damaged in January, 2018, with one needing to be replaced.
