SEVERAL modifications have been made to the development consent for the Taco Bell restaurant approved for a site on the corner of Stewart and Howick streets.

Bathurst Regional Council dealt with a modification request from McDuck Properties last month, which sought to delete four conditions of consent and amend a further five.
The conditions in question were primarily around signage, lighting and odour.
The recommendations from council staff showed they were willing to be lenient in some areas, however stuck by their initial position in others.

It was condition 85 that the councillors seemed to be most concerned with, as the recommendation relating to this was the only item to be altered before adopting the advice of council staff.
The original condition required a sign to be erected on the property that would read:
"Engines must be switched-off when waiting. Any vehicle not adhering to the request of the Store Manager to switch engine off may be refused service. Poorly tuned or malfunctioning cars will be reported to the NSW Environment Protection Authority (EPA)".
McDuck properties wanted the entire condition deleted, however council staff recommended the sign still be installed, but only feature the last sentence.
Councillor Monica Morse did attempt to have the entire condition deleted, saying "it's adding another burden of reporting these noises to the EPA" and that it wasn't necessary.
However, councillors opted to keep the sign as a requirement and simply change the wording to say that vehicles "may" be reported to the EPA, as was suggested by councillor Graeme Hanger.
"It takes away the onus and it's there if it's needed," he said.
In a separate matter dealt with on the night of the September ordinary meeting, councillors resolved to delete a condition that would allow Taco Bell to have a second exit point onto Howick Street, reversing a decision they made in August.
