Magistrate Gail Madgwick heard evidence from an undercover policeman and submissions from the Director of Public Prosecutions and the defendantChr(39)s solicitors yesterday and adjourned the case to consider her finding.
Milan Vranic, 47, of Billman Place, Bathurst, is facing 10 charges and Nenad Vranic, 44, of the same address, five charges.
Both face serious allegations of ongoing supply of heroin between June 19 and 21, 2000, Nenad Vranic on two dates and Milan Vranic, four occasions.
DPPChr(39)s Anne Broomfield told Ms Madgwick the complete brief of evidence relies on the definition of supply, that the brothers were in possession of drugs for supply as co-offenders, had drugs in possession for that purposes with intention.
On the question of financial rewards, Ms Broomfield said there was sufficient evidence in the brief the brothers were part of drug business transactions. Undercover police were told the pair had "customers" and were "busy".
"But guilt obviously and inevitably will be a conclusion for a jury to reach," Ms Broomfield said. "ItChr(39)s a classic case or scenario of two operating in concert for common purpose."
Mr Boyden argued that Ms Madgwick would have a doubt about whether the police evidence supported ongoing supply against one of the brothers, because there were only two occasions when there was direct evidence of supply.
