The entrances into the car parks from the Durham Street side, known as Mrs Blacks Lane and Evans Lane, are littered with substantial potholes and have been there for some time.

Councillor Jess Jennings said the driveways are unsafe, unsightly and "an insult and offensive" to customers of who use them.

"It's a total disgrace," he said.

This is an issue Cr Jennings has raised in Bathurst Regional Council policy committee meetings before and he has been told maintaining those laneways is not the responsibility of council.

He understood the responsibility to maintain the roads fell onto the owners of the Bathurst Chase, Sentinel Property Group (SPG), but SPG has denied this.

SPG told the Western Advocate that, although it is keen to work with council and the landowners, driveway maintenance isn't its responsibility.

"While we have easements to use those driveways, we do not have any legal right to carry out any maintenance or obligation to contribute to the cost of maintenance of those areas," the group said.

"Although we are disappointed the first we hear of this issue is via comments to the media from Cr Jennings, Sentinel is keen to discuss the matter with council and the owners of the land to find a resolution to the problem."

The Western Advocate has previously reported that the road was owned by those who lease out the Hungry Jack's building.

Cr Jennings said he believed council had previously written to the owner of the driveways to ask they be repaired, but the request has seemingly been ignored.

"I came back from holidays the other day and noticed [the potholes] and I've had some people point it out to me again," he said.

"I think they just patched it before, in a pretty poor way, and they really just need to do the job properly once and for all, reseal the whole thing at a higher quality and make sure it is maintained."

Cr Jennings said, with people coming into Bathurst this week for the 12 Hour race, patching should be done now to tidy the driveways up.

"For the race this weekend, how many people are going to go through that car park and go 'Oh yeah, this is Bathurst'?" he said.

He said that, if these were council-owned roads, then the businesses that rely on traffic coming in via thoses driveways would expect council to maintain them to a higher standard.

"If the shoe was on the other foot ... I'm sure we'd be hearing about it, so there's no reason why they shouldn't put their hand in their pocket," Cr Jennings said.
